It is not uncommon, in fact, for a patent owner, after initiating action against an alleged infringer, not only to fail to obtain the desired protection, but even to see their own industrial property title declared invalid.

Patent laws worldwide establish that a patentable invention must not only be new and non-obvious, but also sufficiently disclosed (and, where necessary, illustrated with specific drawings) so that at least one person in the relevant field can reproduce it (Article 51 of Italian Industrial Property Code). In this case, the technical expert appointed during the proceedings found that the patent description was insufficient to enable a skilled person to reproduce the invention, as it lacked essential elements of the claimed solution.

The ruling confirms that patent protection cannot be separated from careful drafting that meets both legal and technical standards. Any negligence in the description, as well as a lack of novelty or inventive step, inevitably leads to the nullity of the patent and the loss of its enforceability.

As clearly shown by the case above, accuracy in preparing patent documentation is not a mere formality but an essential condition yo ensure the validity and actual enforceability of industrial property rights.
Therefore, it is necessary that such drafting be entrusted to qualified professionals, duly registered in the relevant official rolls.
